ABSTRACT

This paper briefly discusses the struggle for access to higher education for students who have historically been excluded from this level of education. These students come from the most sensitive social strata of Brazilian society. This population of students is more vulnerable due to their low family income, color, race and specific needs (people with some kind of disability). The aim is to ascertain the validity of the legislation in correcting this historical debt to this population of students, with regard to the right to higher education, on a federal institute Campus. At the same time, this right is based on human rights as one of the rights of the human being. The methodology used in this research has a mixed qualitative and quantitative approach, which includes document analysis and a search for data available from the National Institute of Educational Studies and Research - Anísio Teixeira - Inep. The results are promising and point to expected percentages of enrollment of students from the most vulnerable social classes at this level of education. They are evidence that the legislation in force, which ensures the democratization of access to higher education, has been effective in correcting inequality and inequity, although it needs to be updated.
